PROCEDURES FOR GRANTING PERMITS FOR WASTEWATER DISCHARGE INTO WATER SOURCES

1. Order of implementation:

Step 1: Prepare a complete set of documents in accordance with the Law.

- For Department level, prepare 01 set of discharging documents and 01 set of Company profile.

- For Ministerial level, prepare 02 sets of discharging documents and 02 sets of Company profile.

- The discharge document includes the following:

+ Application for permit (according to the Form No. 09 in Annex 27/2014/BTNMT)

+ Scheme of discharging wastewater into water sources (Applied to units who have not yet discharged before), Reports on discharging wastewater into water sources (Applied to units who have already discharged); (Form of project or report According to the form No. 35, 36 in Annex 27/2014/BTNMT).

+ Profile of the licencing unit

+ Document attached to the discharge project or discharge report includes:

Data on monitoring of wastewater quality, receiving source (if any);

Monitoring results of wastewater samples before and after treatment (discharge reports)

Plot plan of wastewater and rainwater collection and drainage system

Explanatory reports, drawings of basic design of wastewater treatment system.

Remarks:

- Applying for a Ministry-level discharge permit:

+ Discharging wastewater with a flow of 30,000 m3/day and night or more for aquaculture activities;

+ Discharging wastewater with a flow of 3,000 m3/day and night or more for other activities

- Applying for a Department-level discharge permit:

+ Discharging wastewater with a flow of under 30,000 m3/day and night for aquaculture activities;

+ Discharging wastewater with a flow of under 3,000 m3/day and night for other activities

- For discharging less than 5 m3/day and night, it is not required to apply for a discharge permit; but registration in the local District (except for some production industries specified in Section 5, Article 3 of Circular 27/2014 / BTNMT.

Step 2: Apply at One-stop service Counter, under Department of Natural Resources and Environment or Ministry of Natural Resources and Environment

- When submitting the application, the applicant must submit 01 set of documents at the Department level and 02 sets of documents at the Ministry level; Attached documents have to be notarized.

- Company profile with evidence

- Receiving officials must check the legality and content of the document:

+ If the submitted document is complete and valid, proceed to the next procedure.

+ In case the application is missing or invalid, receiving officials must instructs the person to re-submit it on time.

- After completing all the valid documents, the receiving officer will give appointment note to the applicant.

- Time to receive document: During working hours on weekdays

Step 3: Get a permit at the one-stop counter of the Department of Natural Resources and Environment.

- The person who receives permit shall present the appointment note.

- Organizations and individuals applying for permits to discharge wastewater into water sources must pay charges and fees, collecting officials shall write fee receipts to the payers.

- Receiving officers handling licenses to organizations and individuals, recipient must sign to receive permit.

- Time for returning results: during working hours of the appointment date

2. Implementation:

Directly at the Department of Natural Resources and Environment; Ministry of Natural Resources and Environment

3. Processing time:

30 to 48 working days after receiving complete documents.
